Binternet Rands sues God Almighty [wikipedia.org] for copyright, design-patent, and trademark infringement. Rumored to be acting on behalf of a mysterious organization called Accademia del Cimento, Binternet Rands is suing God Almighty for infringing on the "distinctive design" of the device commonly known as the "Galilean Thermometer."

Through its attorney [wikipedia.org], Binternet Rands claims that the external reproductive organ of the human male is not looks very similar in shape to the "Galilean Thermometer" but both devices are commonly used to measure temperatures.

Legal experts widely dismiss the copyright and design patent claims on a number of fronts, not the least of which is that it is widely assumed that male anatomy was invented first. Asked for comment, Binternet Rands's attorney mumbled something that sounded like "pics or it didn't happen." In addition, any copyrights or patents issued during that time period are almost certainly expired.

The trademark claim cannot be so easily dismissed.

Noted philosopher and writer H. Benderson [amazon.com] notes that while the "Galilean Thermometer" is commonly used to measure air temperatures and the male reproductive organ is commonly used to measure the temperatures of other things, notably parts of the female anatomy and the temperature of showers. As such, Binternet Rands's claims that confusion is very likely cannot be dismissed out of hand. In addition, the "Galilean Thermometer" is sometimes used in a manner similar to the male reproductive organ as a means of providing erotic pleasure, despite wide-spread recommendations not to use breakable glass for such purposes.

There, that's doing it right.

New research led by researchers at North Carolina State University shows that exposure to the chemical bisphenol A (BPA) early in life results in high levels of anxiety by causing significant gene expression changes in a specific region of the brain called the amygdala. The researchers also found that a soy-rich diet can mitigate these effects.

"We knew that BPA could cause anxiety in a variety of species, and wanted to begin to understand why and how that happens," says Dr. Heather Patisaul, an associate professor of biology at NC State and lead author of a paper describing the work. BPA is a chemical used in a wide variety of polycarbonate plastics and epoxy resins, and is used in consumer products such as some food containers.

In the study, rats were exposed to low doses of BPA during gestation, lactation (nursing) and through puberty. One group of animals was fed only soy; one group was fed a soy-free diet; one group was fed only soy and exposed to BPA; and one group was fed no soy and exposed to BPA. Blood tests showed that the animals exposed to BPA had BPA levels well within the range found in humans. Similarly, blood tests of animals fed soy showed levels of genistein, an estrogen-like chemical found in soy, were at levels within the human range for vegetarians and others who regularly consume soy foods.

Among adolescent rats on the soy-free diet, both males and females that had been exposed to BPA exhibited significantly higher levels of anxiety. The researchers also found, for the first time, gene changes within the brain associated with this elevated anxiety.

Specifically, the study reveals that gene expression changes in the amygdala, a brain region known to play a role in mediating responses to fear and stress, are associated with the behavioral changes. Two of the affected genes were estrogen receptor beta and the melanocortin receptor 4. Both are required for oxytocin release, thus changes in oxytocin/vasopressin signaling pathways may underpin the behavioral changes. Oxytocin is a hormone and neurotransmitter that has been linked to social behavior.

However, the researchers also found that adolescent rats on the soy-rich diet did not exhibit anxiety suggesting that the soy-rich diet may mitigate the effects of BPA. But a soy-rich diet raises questions of its own.

"Soy contains phytoestrogens that can also affect the endocrine system, which regulates hormones," Patisaul says. "It is not clear whether these phytoestrogens are what mitigate the effect of BPA, or if it is something else entirely. That's a question we're hoping to address in future research."

On July 17, 1947, The National Association of Real Estate Boards applied to the United States Patent Office to register REALTOR as a trademark. The date claimed for first usage was March 31, 1916.

It first came into common parlance with an utterance by a witness at a subcommittee hearing in 1919. Three years later, Sinclair Lewis used it in his novel, ?Babbitt?. The word appeared in dictionaries in 1917.

Today, most dictionaries define the word as having to do with the National Association of REALTORS?. However, this doesn?t stop language from flowing around the boundaries of law. Many people use the word ?realtor? interchangeably with ?real estate agent?.

In speech, it may be overlooked, but since the NAR does not want the people who are not authorized by the Board to be mixed up with their own members, they are less forgiving of the improper usage of ?realtor? in print, even by REALTORS? themselves.

First of all, if you?re not a REALTOR? and you pass yourself off as one, with the usage of REALTOR or REALTORS in your site or your advertising, NAR is gonna get medieval on yo? assets. It usually starts with a cease-and-desist letter, but gets worse from there.

They aren?t out to get you; they view you as a possible future REALTOR?! However, they do have the power, as the holders of the trademark, to successfully initiate legal action against those who use the word outside of their rules, even as a domain name. So, play nice.

Domain names are tricky, even for a REALTOR? in good standing. For instance, you are perfectly free to register HepzibahSnigglesworthRealtor.com, if Hepzibah Snigglesworth is really your name, but don?t waste your money on ImaRealtorwhocanmakeallyourdreamscometrue.com.

Likewise, if you try to register CrappoRealtor.com and you are not a resident of Crappo, MD, the NAR will not look upon you with a friendly eye.

If you are a resident of Fairdealing, MO, though, you may be able to snag FairDealingRealtor.com. You may register TheBestEverRealtor.com if The Best Ever is the name of your company.

Using variations on REALTOR? is also frowned upon. Creative misspellings, terms that indicate that you are anything but a REALTOR?, even reproduction for novelty items like T-shirts can constitute infringement.

You will have problems if you want to title your Great American Realtor Novel, ?Realtors of Crappo?. It?s always best to contact the NAR when in doubt and get their advice.

One place where you might see some variations on NAR?s protection of its trademarks is the news. Since journalists have their own standards to adhere to, it?s possible that REALTOR? will be used without the identifying trademark symbol.

Newspapers do this because trademarks break up the flow of articles and make them hard to read. However, NAR is on the lookout for articles that use realtor interchangeably with ?real estate agent? or as a label for anything other than what NAR has designated it for.

When in doubt, use a synonym, euphemism, simile, metaphor or contact the NAR. The NAR isn?t out to get you, but it will defend its right to set standards for its trademarks.

The misuse of term REALTOR? is something that the NAR takes seriously, but with a little research, it?s easy to find out what is acceptable use.

(AP) ? It is surely one of the greatest winning streaks in all sports.

Wheelchair tennis player Esther Vergeer won her 468th singles match in a row, a streak that dates to 2003. The latest victory by the 31-year-old Dutchwoman was a 6-1, 6-0 decision over Thailand's Sakhorn Khanthasit in Tuesday's quarterfinals at the London Paralympics.

Vergeer has been No. 1 in the wheelchair tennis rankings for more than 13 years. Richard Krajicek, the 1996 Wimbledon champion, calls her "perhaps the most successful sportsperson of all time."

It is widely believed that only Pakistani squash great Jahangir Khan has had a longer run of consecutive wins ? 555. But that was across five years, from 1981 to 1986. Vergeer's run has taken more than nine years.

"It's not a motivation itself to get to that 555 mark," Vergeer told The Associated Press at Eton Manor, a purpose-built Paralympic venue situated toward the north end of the Olympic Park in east London. "But of course I'm still trying to improve myself, I'm still trying to develop the game of wheelchair tennis.

"If it comes along with it that I win matches, maybe in a few years I'll come close to the 555. But then again there's a lot of girls who work really hard and they are right behind me. I know that. It could be any day that I lose."

The numbers Vergeer has put up since 1996, when she made her first international appearance, are staggering.

She has won 42 grand slam titles (21 singles, 21 doubles) and five Paralympic golds (three singles, two doubles). From 2004-06, she won 250 straight sets. In total, she has won 162 singles titles. And the game she lost against Khanthasit was the only one she has conceded at this Paralympics in three matches.

"My winning run brings a lot of pressure with it," said Vergeer, who has been in a wheelchair since she was 8, when an operation to correct hemorrhaging around her spinal cord left her paraplegic. "Every time I go on court a lot of people have that expectation, and that puts pressure on me. I think it will be good for the game if I lose one day, because that will mean the competition is getting stronger and that there are more girls playing at a higher level."

Vergeer is not only ahead of her rivals in terms of power, being able to fire down serves at speeds of 125 kilometers per hour (78 mph), and technique, in which her dismissive backhand is similar in style to that of Roger Federer.

She is also way ahead in terms of technology.

"Quickie," the name of the wheelchair she uses during matches, is new for the London Games and has a radical design in which Vergeer's legs and knees are locked together and tucked into a device she calls a "bucket" under the chair. In fact, it looks more like a trolley, with two wheels at the front and back. Most competitors just have one wheel at the back and their legs are apart and at right angles.

"It's totally built around me, molded," a proud Vergeer said of her contraption. "I designed it because I think in a regular chair, with a square bucket, you make a lot of movements with your hips and knees, up and down and forwards and backwards. You lose a lot of energy with that, and a lot of placement and pace.

"It's not comfortable ? when I finish training or a match, it's a relief ? but it works. It makes me very stable, it makes feel very strong on the court."

Vergeer, who has four sponsors to allow her to be a full-time tennis player, has a threatening and aggressive demeanor on court, where she constantly circles around in her chair ahead of receiving a serve. Never still, her reaction times are rapid and, as is to be expected from a long-time No. 1, she is a quick thinker on court.

In Tuesday's searing heat, which forced volunteers and officials to duck for cover from the sun behind the large grandstands on Centre Court, there was no hiding place for Khanthasit from Vergeer's punishing strokes.

That delighted the contingent of Dutch fans in the crowd, who wore orange T-shirts and sang songs throughout. They included her parents and brother, who hugged her as she came off court.

"Is there a secret to my success? I don't know," Vergeer said. "There's a lot of combinations and aspects that make me play well ? hard work, determination, just a love of the game of tennis.

"I love to see how far I can go as myself, trying new things. And the team around me just give me all these things to try out and work on ? physical, technical, tactical, equipment, nutrition, all those things. As long as I love the game, I'll continue playing."

That spells bad news for her opponents. The last rival to come close to beating Vergeer was countrywoman Korie Homan, who had a match point in the 2008 Paralympic final in Beijing but lost 6-2, 4-6, 7-6 (5).

Homan is retired now, leaving a host of up-and-coming players from the Netherlands to try and achieve what has so far proved elusive.

Next in line is third-seeded Jiske Griffioen in Thursday's semifinals. Naturally, she is seeking a first win over her training partner.

"I don't know exactly my record against her, and I don't want to search for it either," Griffioen said, laughing. "She's an amazing player and I'm going to have to play my best tennis to beat her, but she has all the pressure on her."
